Customer Responsibilities

Obtaining HOA approval, if required
Disclosing easements, restrictions, or property issues
Clearing the work area where possible
Securing pets and children away from the work area
Marking private underground utilities, sprinkler lines, drainage lines, low voltage wires, invisible dog fences, or other private systems
Providing reasonable access to the project area
Making required payments on time

Public utility marking services may not mark private lines. Sam’s Fence LLC is not responsible for damage to unmarked private utilities, irrigation lines, drainage systems, low voltage wires, or hidden items not disclosed before work begins.

Property Lines, Permits, and HOA Requirements

Customers are responsible for confirming property boundaries unless otherwise agreed in writing.

Sam’s Fence LLC may provide general guidance, but the customer is responsible for ensuring the project complies with property lines, HOA rules, easements, setbacks, and local requirements.

Permit responsibilities will be determined on a project by project basis and should be stated in the written estimate or agreement.

Scheduling

Project timelines depend on weather, material availability, permitting, crew availability, customer approvals, site readiness, and other factors.

Any timeline provided is an estimate and not a guarantee unless specifically stated in writing.

Weather delays, supplier delays, permit delays, change orders, or unforeseen site issues may extend the project timeline.

Payments

Payment terms will be stated in the estimate, invoice, or project agreement.

Customers agree to pay all amounts due according to the agreed payment schedule.

Late payments may delay scheduling, pause work, or result in additional collection costs where allowed by law.

Materials

Material appearance, color, grain, texture, and finish may vary based on supplier, manufacturer, batch, natural variation, age, weather exposure, and availability.

Wood products may warp, crack, shrink, expand, split, fade, or change appearance over time due to natural movement and weather exposure.

Vinyl, aluminum, chain link, wrought iron, composite, and other materials may also experience normal wear, fading, weathering, or manufacturer specific changes over time.

Change Orders

Any changes to the approved project scope may require a written change order and may result in additional costs or timeline changes.

Change orders may include changes to:

Fence length
Fence height
Material type
Gate size or location
Removal and disposal
Site preparation
Repairs
Custom features
Permitting requirements
Additional labor or materials

Warranties

Sam’s Fence LLC may provide warranties on certain materials and workmanship. Specific warranty terms, duration, and exclusions should be confirmed in the written estimate, invoice, or project agreement.

Manufacturer warranties, if applicable, are provided by the manufacturer and are subject to the manufacturer’s terms.

Warranty coverage may not apply to:

Normal wear and tear
Weather damage
Storms, wind, flooding, fire, or acts of God
Ground movement or settling
Customer misuse or neglect
Damage caused by others
Damage from landscaping, vehicles, animals, or equipment
Improper maintenance
Unapproved modifications
Pre existing site conditions
Natural movement of wood or other materials

Cancellations and Rescheduling

Cancellation and rescheduling terms may depend on the project stage.

Customers may be responsible for costs already incurred, including:

Materials ordered
Custom materials
Permit fees
Design work
Administrative work
Labor already performed
Delivery fees
Restocking fees
Subcontractor costs
